SUBJECT: ADVERTISING POLICIES WITH RESPECT TO THIRD PARTY ADVERTISING IN SALT LAKE CITY PUBLICATIONS

PREFACE
From time to time, certain situations arise in which Salt Lake City has the opportunity to include third-party advertising space on City publications. This policy provides guidance related to the appropriate selection processes and content guidelines related to third-party advertising.
The City has determined that it is beneficial to the City and the public to allow certain City publications to contain display advertising for the limited purpose of informing the public of resources available in and near Salt Lake City that are pertinent to the subject matter of such City publication. Funds received from such display advertising will be used either for the production of the City publication at issue, or for the funding of City programs related to such publication.
In allowing the limited advertising described above, the City does not intend to create a public forum, but rather intends to create a limited forum for the purposes set forth herein.
Therefore, the Mayor of Salt Lake City enacts this executive order:
1. City Purpose and Related Advertising Content
Priority will be given in accepting advertising from Salt Lake City-located businesses or organizations whose advertising content is relevant to specific City interests associated with the City publication at issue. Advertising from businesses or organizations will be accepted on a space-available basis if such advertising includes content specifically related to the pertinent City interests.
Advertising content may include business name and logo, location and hours, contact information, the information and logo of specific products, dates of repeating or annual events, and appropriate related images or messages. Advertising content should be relevant for the anticipated useful duration of the City publication at issue. Overly specific or time-limited information that may become outdated, such as prices or a specific sale date, should not be included. Other advertising guidelines pertaining to a specific City publication may be provided at the time the City seeks to obtain advertising related to that City publication.
City personnel may not accept advertisements that contain obscenity, nudity, profanity or include advertising for any illegal products. Likewise, City personnel may not accept proposed advertisements if the City, in its reasonable discretion, deems such advertisements to be in conflict with the City’s health, safety, welfare, business, or law enforcement concerns.
2. Advertising Rates
Whenever advertising is solicited in connection with a City publication, City personnel will set rates for any available display advertising to be sold by the City prior to beginning advertising sales. These rates may be based on or take into account the number of publication copies to be printed and distributed, the size of each display advertisement, and/or the cost of producing and printing the publication. The advertising rates will be printed on an advertising rate schedule for each advertising display opportunity, and such the rate schedule will be available by request from the pertinent City Department.
3. Purchase of Advertising
Any business or entity that desires to purchase display advertising in the pertinent publication location must apply to the pertinent Department of City government during the time period in which advertising content is being solicited by the City. The application must contain the following information: name, address, telephone number of the applicant, billing contact information, advertising contact information, and a photograph, drawing, or other visual representation of the proposed display advertisement. A marked-up copy of a similar display ad, showing any needed content changes, may be accepted for this purpose.
During the advertising solicitation period, City personnel
will accept interest-related advertising applications on a first-come
first-served basis. In the event that requests for advertising space exceed the
advertising space available, the following factors will be considered in
determining which advertising applications will be accepted: (1)
interest-related advertising content, (2) order of receipt of payment, and (3)
order of receipt of application.
4. Payment
Payment for accepted display advertising will be accepted by check made payable to “Salt Lake City” and sent to the pertinent Department of Salt Lake City Corporation. Unless otherwise specified in the advertising solicitation, payment is due within five (5) business days of the City’s acceptance of such advertising application.
5. Use of Advertising Revenue
Funds received from the display advertising will be used either for the production of the City publication at issue or for the funding of City programs related to such publication.
